Terms of Sale
1. DEFINITIONS
1.1 We, us, our means Francesca Oddie Limited.
1.2 You and your mean the purchaser of goods, audio or video content from Francesca Oddie Limited.
1.3 This is a contract between us and you.
1.4 "Lifetime Access" means ongoing and complete access to a course for the life of the program, not for your life or the life of Francesca Oddie.
This is ongoing access at no additional charge until the course is no longer offered, at which time all members will be given at least 1 months notice before a course is closed. Any future closure of the course or community does not affect the refund policy and does not entitle members to any form of refund.
2. CONTRACT
2.1 When you purchase audio or video content from us, we grant you a licence (which is limited, revocable, non-exclusive, non-transferable) to listen to, download or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise copy, reproduce, distribute or use the content other than as set out in this contract. You must not sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom.
2.2 We may terminate your licence to use any purchased products if you breach this contract.
3. PAYMENT
3.1 You may request to make payment by instalments.
If you and we agree that you may make payments by instalments, you must pay all instalments on or before each due date.
3.2 The due date for each instalment is 30 days after purchase and payment of the first instalment and 30 days after each previous instalment.
3.3 All goods sold by us are charged in the currency listed on the order form.
4. ASTROLOGY READINGS AND CONSULTATIONS
4.1 Cancellation and Rescheduling Policy:
(a) If you wish to cancel or reschedule an astrology reading or consultation, you must notify us in advance.
(b) If you cancel or reschedule your appointment with more than 24 hours' notice before the scheduled appointment time, you may do so without incurring any additional charges. You will have the option to reschedule the appointment at a mutually convenient time.
(c) If you cancel your appointment with less than 24 hours' notice before the scheduled appointment time, no refunds or rescheduling options will be available. The appointment fee will be forfeited.
4.2 Refunds:
(a) Refunds for astrology readings and consultations will only be considered under exceptional circumstances and at our discretion. A change of mind or dissatisfaction with the reading does not constitute a valid reason for a refund.
(b) Requests for refunds, if deemed applicable, must be made in writing within 7 days of the initial appointment date.
4.3 Payment and Currency:
(a) Payment for astrology readings and consultations will be made in the currency specified at the time of booking. If you paid in a currency other than English pounds, you may be liable for the costs of currency exchange.
5. COURSES AND MASTERCLASSES
5.1 Voluntary refunds:
(a) If you work through the first few modules of a course and are not totally happy with it, then we will refund your money. Captivate has a 7 day refund period. Learn to Read Your Birth Chart, Learn to Predict and Cosmic Club have a 72 hour refund period.
I believe in my courses and lots of people have experienced amazing insights, fantastic growth, development and results from investing in my programs. This type of progress requires that you follow the course and do the work.
A change of mind does not constitute a valid reason for cancellation and request for a refund. In considering your refund, we may also charge an admin fee of £20 at our discretion.
Requests for refunds must be made in writing within the defined refund period as listed above in section 5.1 (a).
(b) If you receive your money back you must delete every copy of the product and materials that you have downloaded as well as copies you have placed on other devices or media.
(c) being removed or banned from Might Networks or a Telegram group does not entitle you to a refund of your fee.
5.2 If you are entitled to a refund, we will refund your money within two weeks of notice to us and the entitlement arising.
5.3 If you are required to return any goods, you are liable for the cost of returning those goods unless the cost is significant.
5.4 Your refund will be paid in the currency in which it was received by us. If you paid in a currency other than English pounds, you may be liable for the costs of exchange.
6. SUBSCRIPTIONS AND PAYMENT PLANS:
(a) Subscriptions: If you purchase a subscription or payment plan for our services, the following terms apply:
(i) By subscribing to our services, you agree to pay the recurring fees associated with the subscription or payment plan according to the terms specified at the time of purchase.
(ii) The subscription or payment plan will automatically renew at the end of each billing cycle, unless you cancel it prior to the renewal date.
(iii) You authorise us to charge the applicable fees to the payment method you provided at the time of subscription or payment plan setup.
(iv) Any changes to the subscription or payment plan fees will be communicated to you in advance, and you will have the option to accept the changes or cancel your subscription.
(v) We reserve the right to modify, suspend, or terminate the subscription or payment plan at any time, for any reason, without prior notice. In such cases, you will be notified of the termination and provided with any applicable refund or credit.
(b) No Cancellations for Future Payments: Once you have subscribed to a recurring payment plan, you acknowledge and agree that cancellation requests made after the initial refund period specified in section 4.1(a) will not entitle you to a refund for future payments. You are responsible for fulfilling the remaining payment obligations as per the subscription or payment plan terms.
(c) Non-Transferability: Subscriptions or payment plans are non-transferable. You may not transfer, assign, or sell your subscription or payment plan to any other person or entity without our prior written consent.
(d) Administrative Fees: In the event of a refund request for a subscription or payment plan, we may charge an administrative fee of £25 at our discretion.
(e) Currency Conversion: If your payment was made in a currency other than English pounds, you may be liable for the costs of currency exchange required for refund processing.
Please note that these additional terms apply specifically to subscriptions or payment plans and do not alter the refund policy stated in section 4 & 5.1 for other products or services.
7. Failed Payments:
(a) In the event of a failed payment for a subscription or payment plan, the following terms apply:
(i) If a payment fails to process due to insufficient funds, an expired payment method, or any other reason, we will notify you of the failed payment and provide instructions on how to update your payment information.
(ii) If the payment is not successfully resolved within 14 days from the initial failed payment, we reserve the right to suspend or terminate your subscription or payment plan, without prior notice.
(iii) You acknowledge and agree that any interruption or termination of your subscription or payment plan due to a failed payment does not relieve you of your payment obligations. You remain responsible for fulfilling the remaining payment obligations as per the subscription or payment plan terms.
(iv) We may attempt to reprocess the failed payment periodically, depending on the circumstances and our discretion. However, we make no guarantees regarding the number of reattempts or the duration of reprocessing attempts.
(b) Fees and Consequences:
(i) In the event of a failed payment, you acknowledge and agree that you may be subject to additional fees or penalties. These fees or penalties may include, but are not limited to, late payment fees, interest charges, or suspension or termination of your access to our products or services. It is your responsibility to ensure that your payment information is accurate and up to date to avoid any potential payment failures and associated consequences.
(ii) Failure to rectify a failed payment or fulfil your payment obligations may result in the suspension or termination of your subscription or payment plan, and we may pursue other available remedies to recover the outstanding amount, including legal action.
(iii) You acknowledge and agree that if legal action is taken to recover the outstanding amount, you may be responsible for any associated court costs or legal fees.
(c) Payment Method Update:
(i) It is your responsibility to ensure that your payment method information is accurate, up to date, and capable of processing payments.
(ii) You may update your payment method information by following the instructions provided by us or by accessing your account settings.
(iii) We are not responsible for any consequences, including service interruptions or termination, resulting from your failure to update your payment method information.
Please note that these additional terms regarding failed payments are specific to subscriptions or payment plans and do not supersede or alter any other provisions in the terms of sale.
8. CLIENTS AND MAILING LIST SUBSCRIPTION
By engaging in transactions, purchasing goods, or utilising our services, you acknowledge and agree that you will be added to our mailing list. As a client or customer of Francesca Oddie Astrology Ltd., you may receive communications from us, including but not limited to newsletters, promotional offers, and updates related to our products and services.
If you have subscribed to our mailing list and are also a client, your contact information, such as your email address, may be used for both transactional and marketing purposes. We may use this information to communicate with you about your orders, provide important updates, and share relevant content that we believe may enhance your experience with Francesca Oddie Astrology Ltd.
You have the right to opt out of marketing communications at any time. To exercise this right, you can use the "unsubscribe" or "opt-out" link provided in our marketing emails or contact us directly at support@francescaoddie.com.
Please note that even if you choose to opt out of marketing communications, you may still receive transactional emails related to your purchases or other essential communications related to the services we provide.
9. TRADE MARKS
9.1 Trade marks used on the Website belong to their respective owners. You must not use any trademark displayed on the Website without the express written permission of us or the third-party owner.
10. EVENTS
10.1 Cancellation policy: Tickets are non-refundable.
10.2 Event: Francesca Oddie Ltd. reserves the right to change the event at any time, this includes location. In the unlikely event that this will happen, every effort will be made to ensure an event of an equivalent standard in a reasonable distance from the original location.
10.3 Behaviour: Francesca Oddie Ltd. reserves the right to prohibit entry or eject any person from the Venue based on behaviour deemed inappropriate by Francesca Oddie Ltd. staff and/or its agents and others working under its authority.
